Chapter 4 – Henry’s Final Weeks

Henry spent his remaining six weeks in quiet, careful conversation with his longtime attorney, a family friend named Ms. Reed who had handled the ranch’s legal affairs for over two decades and understood, better than almost anyone, exactly what Henry hoped to accomplish with the provisions he was now determined to include.

“I don’t want to simply divide the ranch between them,” Henry told her, during one of several private meetings arranged around his declining but still lucid days. “If I do that, I think it destroys them both, and destroys the ranch along with it. I need something that forces them to actually work this out, rather than just splitting the assets and going their separate ways, resentful of each other for the rest of their lives.”

Ms. Reed, drawing on decades of experience with exactly this kind of family conflict, proposed an unusual but legally sound structure — the ranch would pass to both children jointly, but only on the condition that they operate it together for a full year following Henry’s death, with neither permitted to buy out the other or sell their share during that period. If, at the year’s end, they still couldn’t reach agreement on the ranch’s future, the entire property would pass instead to a regional land conservation trust, permanently removing it from either sibling’s control.

“That’s a significant risk,” Ms. Reed cautioned. “They might simply let the year run out, out of spite, and lose the ranch entirely rather than compromise with each other.”

“I know the risk,” Henry said. “I’d rather risk losing the ranch to a conservation trust than watch it become the reason my children never speak to each other again. If they can’t find their way to working together over something I built, then perhaps neither of them should have it at all.”

The will was finalized two weeks before Henry’s death, its unusual condition carefully documented and legally airtight, designed specifically to force a resolution neither Colin nor Audrey had yet managed to reach on their own.
